Terms of Service – Mount Clear College Digital Services

1. Overview

These Terms of Service apply to digital services operated by Mount Clear College (the Services), including internal portals and web applications.

The Services are provided for the use of authorised Mount Clear College and Department of Education users only, including staff and students. By accessing or using the Services, you agree to comply with these Terms.

2. Relationship to Department Policies

Mount Clear College is a Victorian government school. Use of the Services is also subject to applicable Department of Education policies, including:

• Acceptable Use policies
• Privacy and information management policies
• Student engagement and wellbeing policies

Where there is any inconsistency, Department of Education policies take precedence over these Terms.

3. Access and Authorisation

Access to the Services is restricted to authorised users only. Authentication may be managed through secure identity systems, including OAuth and SAML-based authentication providers.

As part of access management, identity information may be processed or stored by Mount Clear College and its authentication providers solely for the purposes of authentication, access control, session management, and security.

Access may be suspended or revoked at any time if:

• A user is no longer authorised (e.g. staff departure or student exit)
• The Services are misused
• Access must be restricted for security, legal, or operational reasons

4. Acceptable Use

Users must use the Services responsibly and only for legitimate school-related purposes. Users must not:

• Attempt to bypass access controls or security measures
• Use the Services for unlawful, harmful, or inappropriate activities
• Interfere with the operation, integrity, or availability of the Services
• Access or attempt to access information they are not authorised to view

5. Availability of Services

The Services are provided on an as-is and as-available basis. While reasonable efforts are made to ensure availability, uninterrupted or error-free access is not guaranteed.

Services may be modified, suspended, or withdrawn at any time for maintenance, security, compliance, or operational reasons.

6. Data and Privacy

Personal information collected or processed through the Services is handled in accordance with the Victorian Department of Education Privacy Policy and relevant legislation.

Users should refer to the applicable Privacy Policy for information about data collection, use, storage, and retention practices.

7. Liability

To the extent permitted by law, Mount Clear College is not liable for any loss, damage, or disruption arising from the use of, or inability to use, the Services.

Nothing in these Terms limits any rights or remedies that cannot be excluded under applicable law.

8. Changes to These Terms

These Terms may be updated from time to time to reflect changes to the Services, authentication methods, or governing policies.

Continued use of the Services after changes are published constitutes acceptance of the updated Terms.
